1. SoldByMe’s role
SoldByMe provides fixed-fee online publishing, marketing-support and independent-provider introduction services. SoldByMe is not a real estate agency and does not act as agent for a seller or buyer. It does not appraise property, conduct viewings, negotiate price or conditions, prepare sale and purchase agreements, give legal or financial advice, receive offers on behalf of a party or hold deposits.
2. Seller responsibilities
The seller controls the advertisement and remains responsible for the property, asking price or sale method, buyer communications, viewings, negotiations, disclosures, decisions and legal transaction. A seller must be the owner or hold the owner’s authority, provide accurate and non-misleading material, own or have permission to use submitted media, and promptly correct or remove outdated information.
3. Moderation and listings
Submitted listings are moderated and may be rejected, paused, edited for formatting with the seller’s approval, or removed for suspected inaccuracy, illegality, safety concerns, rights infringement, non-payment or breach of these terms. Moderation is not verification, valuation, legal approval or endorsement. Listing duration and inclusions are those stated in the purchased package.
4. Buyers
Property information is supplied by the seller or identified independent provider. Buyers must verify material facts and obtain advice appropriate to the property and their circumstances. Contacting a seller does not create a contract with SoldByMe. Buyers should have their lawyer review an agreement before signing and should consider their own building, valuation, insurance, finance and specialist checks.
5. Independent providers
Introduced providers are independent businesses, not employees or agents of SoldByMe. Unless expressly stated in writing, the customer selects and contracts directly with the provider, who is responsible for scope, price, timing, credentials, insurance, advice, reports and workmanship. SoldByMe does not guarantee provider availability or outcomes.
6. Reports and documents
Reports remain subject to their author’s scope, assumptions, limitations, copyright and reliance provisions. A report commissioned by a seller may not be relied upon by a buyer. SoldByMe does not alter professional conclusions and publication does not make SoldByMe responsible for a report.
7. Payments
Package charges are one-off fixed fees in NZD. SoldByMe is not currently GST registered, so no GST is added. Stripe processes card payments. Independently supplied services may be quoted and invoiced separately by the provider.
8. Acceptable use
Users must not submit unlawful, discriminatory, deceptive, defamatory, infringing, malicious or unsafe content; impersonate another person; scrape or misuse personal information; interfere with the site; or use SoldByMe to evade any legal or professional obligation.
9. Liability
To the extent permitted by New Zealand law, SoldByMe is not liable for property condition, title, value, transaction decisions, provider acts or omissions, seller or buyer statements, or indirect loss. Nothing in these terms excludes rights that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
10. Contact and changes
Contact enquiries@soldbyme.co.nz. We may update these terms prospectively by publishing a revised date. New Zealand law governs these terms.
